In many jurisdictions, the legal basis is strict, no-fault liability for animal owners, under which the keeper of an animal is liable for damage caused by the animal’s behavior regardless of any fault on the keeper’s part, since keeping an animal is regarded as an elevated, not fully controllable source of risk; for certain agriculturally kept animals, this heightened liability may be limited by proof that due care was exercised in supervising the animal.
Relevance for Horse Owners and Agriculture
Because of the particularly high loss potential associated with horses, which, due to their size and strength, can cause significant bodily injury and property damage, animal owner liability insurance is of particular practical importance for horse owners; in agriculture, cover is frequently included as part of a comprehensive general liability policy, but can also be purchased separately depending on the livestock kept.
Comparison and delineation
Animal owner liability insurance complements personal liability insurance, which typically already includes small household pets but usually excludes or caps cover for horses and farm livestock given their materially higher loss potential; a dedicated policy is therefore needed once a household keeps such animals. In an agricultural context, the same exposure is frequently complemented by, or embedded within, general liability insurance covering the farm operation as a whole, so the choice between a stand-alone animal owner policy and an extension of the farm’s general liability cover depends on whether the animals are kept privately or as part of the commercial operation.
