Purpose
For fixed-term insurance contracts, it would be impractical if the insurer and policyholder had to actively re-conclude the contract before every expiry. The automatic renewal clause therefore provides that, absent timely termination, the contract continues automatically, so continuity of cover does not depend on an active act of renewal.
Effect and limits
To protect policyholders from an unlimited, effectively non-terminable commitment, all three jurisdictions cap the duration of any single automatic renewal at one year; a longer renewal agreement is invalid to that extent, even where the original contract was concluded for several years. The ordinary notice period for termination at the end of each period is unaffected and must be observed to prevent renewal.
Negotiation and practice
In commercial insurance, the notice period itself is frequently negotiated to give policyholders more time to change provider, while insurers have an interest in sufficient lead time for renewal underwriting. Digital reminder systems for termination deadlines are now a standard service offered by many brokers to avoid unwanted automatic renewals.
Jurisdictional comparison
Switzerland declares any renewal agreement invalid under Art. 47 VVG insofar as it extends beyond one year per renewal. Germany likewise caps renewal at one year under Section 11(1) VVG, irrespective of the originally agreed contract duration. Austria provides for a substantively identical maximum duration in Section 8(1) VersVG, so the concept is broadly aligned across all three jurisdictions.
