      "body": "## Concept\n\nThe duty to mitigate loss is a policy condition imposed on the policyholder in the event of an insured event, requiring the policyholder to take reasonable measures to avert or reduce a threatened or already occurred loss. It applies both before and after the occurrence of the insured event and supplements the policyholder's general duty of disclosure and information.\n\n## Scope of Reasonable Measures\n\nTypical measures expected within the bounds of reasonableness include promptly shutting off a water supply after a pipe burst, calling the fire brigade in the event of a fire, or providing first aid to an injured person; which measures are specifically reasonable depends on the circumstances of the individual case, in particular the objective feasibility and proportionality of the action for the policyholder.\n\n## Legal Consequences of Breach\n\nIf the policyholder breaches the duty to mitigate loss intentionally or through gross negligence, the insurer may reduce its benefit in whole or in part, to the extent the breach was causal for the amount of the loss actually incurred; a causation test is generally decisive here, under which the reduction in benefit is limited to the extent of the additional loss caused by the breach of the policy condition."

      "body": "## Begriff\n\nDie Schadenminderungspflicht ist eine dem Versicherungsnehmer im Versicherungsfall auferlegte Obliegenheit, mit der ihm zumutbare Massnahmen zur Abwendung oder Minderung des drohenden oder bereits eingetretenen Schadens abverlangt werden. Sie gilt sowohl vor als auch nach Eintritt des Versicherungsfalls und ergänzt die allgemeine Anzeige- und Auskunftspflicht des Versicherungsnehmers.\n\n## Umfang der zumutbaren Massnahmen\n\nZu den typischen, im Rahmen der Zumutbarkeit erwarteten Massnahmen zählen etwa das unverzügliche Abstellen einer Wasserleitung nach einem Rohrbruch, die Alarmierung der Feuerwehr bei einem Brand oder die medizinische Erstversorgung eines Verletzten; welche Massnahmen konkret zumutbar sind, richtet sich nach den Umständen des Einzelfalls, insbesondere der objektiven Möglichkeit und Verhältnismässigkeit des Handelns für den Versicherungsnehmer.\n\n## Rechtsfolgen bei Verletzung\n\nVerletzt der Versicherungsnehmer die Schadenminderungspflicht vorsätzlich oder grob fahrlässig, kann der Versicherer seine Leistung ganz oder anteilig kürzen, soweit die Verletzung für die Höhe des tatsächlich entstandenen Schadens ursächlich war; massgeblich ist dabei regelmässig eine Kausalitätsprüfung, wonach die Leistungskürzung auf den Umfang des durch die Obliegenheitsverletzung zusätzlich verursachten Schadens begrenzt bleibt."
