      "body": "## Concept and Legal Bases\n\nA cost approval is the payer's prior assurance that it will reimburse a planned service. It provides legal certainty for providers and patients before costs are incurred and allows the insurer to review indication, cost-effectiveness and tariff. Basic insurance provides for it in several places: for inpatient treatment outside the canton of residence for medical reasons, the canton of residence pays its share only with a cost approval (Art. 41 para. 3 KVG); Annex 1 of the KLV expressly ties individual benefits – such as certain surgical procedures, genetic tests or rehabilitation stays – to prior cost approval by the insurer after consulting the medical examiner. Outside these cases, cost approval in basic insurance is declaratory, because the statutory entitlement does not depend on it.\n\n## Supplementary Insurance and International Practice\n\nIn hospital supplementary insurance under the VVG, by contrast, cost approval is an integral part of the policy conditions: before a planned admission to a semi-private or private ward, hospitals obtain the supplementary insurer's confirmation of cover, and the insurer checks the insurance cover, any exclusions, waiting periods, recognition of the hospital and the agreed tariffs for additional services. Without approval the insured person risks bearing the additional costs. Functionally this corresponds to pre-authorisation in international private medical insurance (IPMI), where the insurer issues a guarantee of payment to the hospital after reviewing medical necessity and the treatment is settled by direct billing. Cost approval processes are also the entry point for case management and steering patients to suitable facilities.\n\n## Country Comparison\n\nIn Germany the health fund must decide on approval requests under § 13 para. 3a SGB V within three weeks, or five weeks if the Medical Service is involved; once the deadline passes the service is deemed approved. Private health insurers issue written benefit confirmations on request that are binding under the model terms. Austria has benefits subject to prior approval by the chief medical service of the ÖGK."

      "body": "## Begriff und Rechtsgrundlagen\n\nDie Kostengutsprache ist die vorgängige Zusicherung des Kostenträgers, eine geplante Leistung zu vergüten. Sie schafft für Leistungserbringer und Patienten Rechtssicherheit, bevor Kosten entstehen, und ermöglicht dem Versicherer die Prüfung von Indikation, Wirtschaftlichkeit und Tarif. In der Grundversicherung ist sie an mehreren Stellen vorgesehen: Bei stationärer Behandlung ausserhalb des Wohnkantons aus medizinischen Gründen übernimmt der Wohnkanton seinen Anteil nur mit Kostengutsprache (Art. 41 Abs. 3 KVG); die KLV knüpft in Anhang 1 einzelne Leistungen – etwa bestimmte chirurgische Eingriffe, genetische Untersuchungen oder Rehabilitationsaufenthalte – ausdrücklich an eine vorgängige Kostengutsprache des Versicherers nach Konsultation des Vertrauensarztes. Ausserhalb dieser Fälle hat die Kostengutsprache in der OKP deklaratorischen Charakter, weil der gesetzliche Leistungsanspruch nicht von ihr abhängt.\n\n## Zusatzversicherung und internationale Praxis\n\nIn der Spitalzusatzversicherung nach VVG ist die Kostengutsprache dagegen fester Bestandteil der Vertragsbedingungen: Spitäler holen vor einem geplanten Eintritt in die halbprivate oder private Abteilung die Deckungsbestätigung des Zusatzversicherers ein, der Versicherungsdeckung, allfällige Vorbehalte, Wartefristen und die Anerkennung des Spitals sowie der vereinbarten Mehrleistungstarife prüft. Fehlt die Gutsprache, riskiert die versicherte Person, die Mehrkosten selbst zu tragen. Funktional entspricht dies der Pre-Authorisation in der internationalen Krankenversicherung (IPMI), bei der der Versicherer nach Prüfung der medizinischen Notwendigkeit eine Guarantee of Payment an das Spital ausstellt und die Behandlung im Direct Billing abgerechnet wird. Kostengutspracheprozesse sind zugleich Ansatzpunkt für Case Management und Steuerung in geeignete Einrichtungen.\n\n## Ländervergleich\n\nIn Deutschland entscheidet die Krankenkasse über Genehmigungsanträge nach § 13 Abs. 3a SGB V innert drei Wochen, bei Einschaltung des Medizinischen Dienstes innert fünf Wochen; nach Fristablauf gilt die Leistung als genehmigt. Die private Krankenversicherung erteilt auf Anfrage schriftliche Leistungszusagen, die nach den Musterbedingungen eine Bindungswirkung entfalten. In Österreich bestehen bewilligungspflichtige Leistungen mit chefärztlicher Genehmigung durch die ÖGK."
