      "body": "## Concept\n\nArt. 7 para. 1 UVG treats as an occupational accident any accident the insured person suffers while performing work on the employer's instruction or in the employer's interest, as well as accidents during work breaks and before or after work, provided the person is lawfully present at the workplace or within the area of hazards connected with the occupation. What matters is therefore not the location alone but the material and temporal link with the work. The general definition of accident (Art. 4 ATSG) must also be met. Under Art. 12 UVV accidents on business trips and at events organised by the employer also count as occupational accidents.\n\n## Distinction from non-occupational accident\n\nAll accidents that are not occupational accidents are non-occupational accidents (Art. 8 UVG). The distinction determines who pays the premium: the premium for occupational accidents and occupational diseases is borne solely by the employer (Art. 91 para. 1 UVG), the premium for non-occupational accidents in principle by the employee. For part-time employees working fewer than eight hours a week, who are not insured against non-occupational accidents, the commute expressly counts as an occupational accident (Art. 7 para. 2 UVG) – Switzerland therefore has no separate category of commuting accident. On the benefits side the UVG treats both categories alike; reductions for gross negligence, however, apply only to non-occupational accidents (Art. 37 para. 2 UVG).\n\n## Country comparison\n\nIn Germany the counterpart is the Arbeitsunfall under § 8 SGB VII, in Austria the Arbeitsunfall under § 175 ASVG; both include commuting accidents and are financed solely by the employer. Unlike in Switzerland, statutory accident insurance in those countries does not extend to leisure accidents, which are covered by health insurance or private accident insurance."

      "body": "## Begriff\n\nArt. 7 Abs. 1 UVG erfasst als Berufsunfall jeden Unfall, den die versicherte Person bei Arbeiten erleidet, die sie auf Anordnung des Arbeitgebers oder in dessen Interesse ausführt, sowie Unfälle während der Arbeitspausen und vor oder nach der Arbeit, sofern sie sich befugterweise auf der Arbeitsstätte oder im Bereich der mit ihrer beruflichen Tätigkeit zusammenhängenden Gefahren aufhält. Massgebend ist damit nicht der Ort allein, sondern der sachliche und zeitliche Zusammenhang mit der Arbeit. Der allgemeine Unfallbegriff (Art. 4 ATSG) muss zusätzlich erfüllt sein. Als Berufsunfälle gelten nach Art. 12 UVV auch Unfälle bei Geschäftsreisen und bei vom Arbeitgeber organisierten Anlässen.\n\n## Abgrenzung zum Nichtberufsunfall\n\nAlle Unfälle, die keine Berufsunfälle sind, gelten als Nichtberufsunfälle (Art. 8 UVG). Die Abgrenzung entscheidet über die Prämientragung: Die Prämie für Berufsunfälle und Berufskrankheiten trägt allein der Arbeitgeber (Art. 91 Abs. 1 UVG), jene für Nichtberufsunfälle grundsätzlich der Arbeitnehmer. Für Teilzeitbeschäftigte mit weniger als acht Wochenstunden, die nicht gegen Nichtberufsunfälle versichert sind, zählt der Arbeitsweg ausdrücklich als Berufsunfall (Art. 7 Abs. 2 UVG) – die Schweiz kennt somit keinen eigenständigen Wegeunfall. Leistungsseitig behandelt das UVG beide Kategorien gleich; Kürzungen wegen Grobfahrlässigkeit betreffen jedoch nur Nichtberufsunfälle (Art. 37 Abs. 2 UVG).\n\n## Ländervergleich\n\nIn Deutschland entspricht dem Berufsunfall der Arbeitsunfall nach § 8 SGB VII, in Österreich der Arbeitsunfall nach § 175 ASVG; beide schliessen den Wegeunfall ein und werden allein vom Arbeitgeber finanziert. Anders als in der Schweiz erstreckt sich die gesetzliche Unfallversicherung dort aber nicht auf Freizeitunfälle, die über die Krankenversicherung oder eine private Unfallversicherung abgedeckt werden."
