Innerhalb dieser Erweiterung schliessen Versicherer Ansprüche, die vor US-amerikanischen oder kanadischen Gerichten geltend gemacht oder nach dortigem Recht beurteilt werden, jedoch regelmässig erneut ausdrücklich aus, da das dortige Haftungs- und Prozessrecht ein deutlich abweichendes Risikoprofil aufweist.\n\n## Wirkung und Grenzen\n\nUrsächlich für den Ausschluss sind insbesondere das US-amerikanische Erfolgshonorarsystem für Anwälte, die Möglichkeit umfangreicher Beweisausforschung (Discovery) sowie das Risiko erheblicher Strafschadenersatzzahlungen (Punitive Damages), die in einer Grössenordnung liegen können, die europäische Deckungskonzepte sprengt. Der Ausschluss betrifft sowohl allgemeine Betriebshaftpflichtansprüche als auch – besonders praxisrelevant – die Produkthaftpflicht bei Exporten in den nordamerikanischen Markt.\n\n## Verhandlung und Praxis\n\nUnternehmen mit Exportgeschäft in die USA oder nach Kanada sollten den Ausschluss gezielt zurückkaufen oder eine eigenständige USA/Kanada-Deckung, häufig über eine im Zielmarkt zugelassene Fronting-Police, aufbauen. Bei der Prüfung ist zu klären, ob der Ausschluss auf den Erfüllungsort des Schadens, den Sitz des Klägers oder das anwendbare Recht abstellt, da diese Anknüpfungspunkte den tatsächlichen Deckungsumfang erheblich beeinflussen."
